Hey everyone, I need some advice on a sticky situation at work. 🤔
So, I recently started working at a gas station in California, and the GM is refusing to reimburse us for our food handlers cards, even though it’s required by law (SB476). To make matters worse, one of the owners tried to bribe us with fried chicken as a “reimbursement.” 🍗
I’m extremely frustrated because some of my coworkers are struggling financially, and the owners seem to be flaunting their wealth while refusing to follow the law. 😡
I have screenshots of the entire conversation. Do you know which agency I can report this to? Can I take legal action? I’m worried about retaliation, but I can’t let this go.

If you decide to take the course, you can file a wage claim for you unpaid time taking the course. Not sure what you can do about the expense itself. But filing a wage claim protects you, because employers are explicitly forbidden from retaliating.
If the employer retaliates, you’ll need a lawyer, but having a clear cut case of wage claim on file will make it a lot easier to find a lawyer on contingency.
Right now lay low and don’t argue with your employer. You can’t file a wage claim until you’ve actually worked those hours and your employer has actually failed to pay you for them.

Just FYI, the SB number you’ve given is just the bill proposed to amend the law. The actual law you want to site is Section 113948(i) of the California Health and Safety Code.
It is also worth noting that it’s actually a criminal offense for the business to violate the Health Code. Most violations are misdemeanors. You can likely report to your local or state public health department if you are looking for help enforcing the law. They should be able to either help you or point you in the right direction.

Department of industrial relations is the governing body that enforces the new law. Contact them.
Call the State of California Labor Commissioner’s Office at 833-LCO-INFO (833-526-4636) and let them know what’s happening. They will react.
