🍴 Hey everyone, I need some advice on a sticky situation at work. My coworkers are being forced to work during their lunch breaks to avoid getting into trouble with the Department of Labor. It’s causing a lot of stress and frustration among us. Here’s the dilemma:
🍔 Some coworkers are clocking out for their lunch break but then going back to work in order to finish their tasks on time.
🍟 Others have told me not to report this because they’re afraid of getting in trouble with the manager.
🥗 I tried talking to the manager about the workload being too much, but they won’t listen or make any changes.
What should I do in this situation? I want to help my coworkers and ensure fair labor practices are being followed. Here are some possible solutions that I think could help:
– Schedule a meeting with the manager to discuss workload and time management.
– Encourage coworkers to speak up as a group to address the issue.
– Reach out to HR or a higher authority if necessary to report the unfair practices.

Definitely report it. To the local labor board. Give the labor board your name. That way, after they get called out for their behavior, they can’t fire you without looking like it’s retaliation. Then sue them with the help of a labor attorney. They will take the case and their pay will come out of your winnings or settlement.
Report to DOL. This is wage theft.
If you guys can’t take lunches for rest and nutrition. That can make you more susceptible to accidents . This is something OSHA should be contacted about.

But also, your co workers need to stop clocking out and still working. If she fires them, they can claim unemployment and when she comes to dispute it the whole story will come out in court.
Isn’t it so wild that workers will willingly forfeit their own rights to avoid getting in trouble with the employer because of the way the employer themselves has shit set up?!?!?

I would never work in a kitchen for free. If you’re not clocked in, workman’s comp won’t cover anything that happens. I’m pretty sure, anyway.
