They can (and anybody can sue really for anything) but as long as what was said is truth, youβll be fine.
Where do you live? Different jurisdictions have different rules on defamation.
You can be sued for defamation if what you’re saying isn’t true. That defamation case can include injuries, which in a physicians case would more than likely result in lost patients (in the practice), which can amount to alot of money really quickly.
Make sure what you’re saying is true, if its true, hard for the physician to win a defamation case…Mind you, the surgeon can just largely say “thats not true” and start a very costly, and long legal battle.
In USA, it’s almost impossible to get one doctor to testify against another one – unless the outcome was horrendous. Also, they can change their notes from the actual situation.
If the work was subpar (i.e. below the standard of care), a medical malpractice attorney would be willing to take the case on contingency (i.e. they don’t get paid unless they win). The fact that multiple lawyers didn’t want to take the case on is a bad sign. Most malpractice insurance companies will at least pay out a small amount (up to $100K or so) to settle “nuisance” claims because itβs cheaper than going to trial. So your attorneys didn’t even think they could get a settlement out of it.
You had some surgeons tell you that the work was subpar but would they be willing to testify to that in a court of law? Did they have access to all the details of you case when they made those statements? Malpractice attorneys usually consult with an expert in the field to see if they have a case or not. In almost every state, an expert in the field is required to testify that the standard of care was not met.
If you post reviews stating that the work was subpar the surgeon absolutely could sue you. They may or they may not have a case….that would have to be decided by the legal process. But it could still cost you a lot of money in legal fees.
I would tread carefully. Before you post any review, it might be a good idea to speak with an attorney to look at your potential legal liability. A consultation would be much cheaper than any legal defense fees you’d incur in a defamation suit.
