🌲 #NeighborTreeDispute 🌲
So, here’s the lowdown, my neighbor wants to chop down a beautiful old White Pine tree that isn’t even on their property! Can you believe it? Here’s the scoop:
- Neighbor claims the tree drops needles in his yard and makes his kids’ feet sticky 🙄
- Tree is on the property of a 90-year-old man who wants to keep it
- Arborist says the tree is healthy and shouldn’t be cut down
Now, here’s where I need your help and expertise:
- Can the neighbor legally force the owner of the tree to cut it down?
- As a tree-supporting neighbor, how can I fight this?
Personally, I think communication is key in situations like this. Maybe organizing a neighborhood meeting to discuss the benefits of the tree and find a compromise could work. Saving a 200+ year old tree is definitely worth it 🌳💚
What do you think? Any advice or ideas to share? Let’s chat!
They cannot force the middle neighbor to cut the tree. However, they are clearly trying to bully him into it. You can offer the middle neighbor assistance in saying no. You could also contact any arborist providing quotes regarding the tree to let them know that the landowner doesn’t actually want his tree cut and is being bullied by the neighbor requesting the quote. I’m presuming arborists will not want to get into the middle of such a situation.
Hang a sign around the tree. DO NOT CUT.
I think the neighbor trying to get the tree cut down needs to be informed what the tree is worth & what it will cost to replace if they illegally cut it down. If the neighbor who owns the tree can afford it, they may want to consider a fence. At a minimum, put up a couple of no trespassing signs & if possible a camera. The tree owning neighbor should also get statements of health from both tree companies.
Tell the neighbor that want it cut down they may find themselves liable for thousands upon thousands upon thousands of dollar in damages if the tree is indeed that old and large. Trees like this are extremely expensive to replace. Not only that but the owner of the property could loose property value as well without the tree. Nothing at all to take lightly just because you don’t like sappy feet
In addition to the other advice in the comments, I would recommend making sure they take extensive photos of the tree and possibly get an arborist to assess the trees value ahead of anything happening so that they have a good paper trail of the trees value in the event it does end up getting cut
make sure your 90year old neighbor knows he has zero obligation to allow arborists on to his property to look at the tree
NAL. A healthy 200 year old tree is a precious thing. Depending on where you are, it may predate the formation of the state, or admittance of the state to the US.
It may be possible for it to be designated a historical landmark, which would provide a whole additional level of protection.
If the tree is posing no danger, how on earth does this entitled douchebag plan to force the owner to remove it?
It’s not his, he can fuck off.
