I’m sorry for the loss of your dogs, but there’s probably nothing to do here. Did the vet give you a diagnosis of something like kennel cough? That’s what it sounds like from the symptoms. If so, it doesn’t really show any kind of negligence on the part of the boarding facility on it’s own. It’s not a result of particularly unclean conditions, just a consequence of having a large number of dogs in tight quarters, as in almost every boarding facility/kennel.
You can sue in small claims court for the cost of the dogs. And file a police report. I’m so sorry, how awful.
You need to get a necropsy to determine cause of death before you can blame the facility. Without cause of death your case will be dismissed b/c you can’t explain why they died. Also, were your dogs fully vaccinated for kennel cough (bordatella)? If not, the blame may legally fall to you, not the facility (assuming this was kennel cough).
I’m so sorry. It sounds like they died from respiratory illness. If the boarding facility were negligent in causing an injury to Juno’s leg, it seems to be unrelated to her death. Communicable illnesses are a risk at boarding facilities and anywhere where dogs gather in large groups. Unless you have some reason to believe the facility did something wrong (like not cleaning properly, not isolating sick dogs), it will be hard to do anything legally. You should talk to your vet about what caused their deaths and whether the facility could have done anything wrong. You could also investigate if anyone else has had these kinds of problems with the facility.
You may be able to report the facility to a state agency, depending on your location. They might be interested in investigating an outbreak for the sake of public health.
Good responses here. I’m a lawyer but not your lawyer. In general as much as we all love animals (we have 2 rescues) they are considered chattel under the law. Meaning even if you get your pound of flesh in a lawsuit. Usually the max you will ever win is cost of dog. Rarely would you win emotional distress. I don’t know what State OP resides in.
You could pay for a necropsy to determine that cause of death. Were they fully vaccinated and up to date? Were they vaccinated against kennel cough and canine influenza? Both are highly contagious and canine influenza is pretty deadly. I ask this because if this was found to be the cause of death the question of preventative measures on the part of the own would surely be posed.
