Ask her how expensive lawyer fees and up to 100 000 dollars in fines plus a possible jail sentence for up to a year in prison sounds to her.

Here’s your biggest issue… Since she filmed you, she owns the copyright or “poor mans copyright,” meaning if she uploads that as content to share publicly or sell… you have no recourse under the DMCA laws to have that video removed. You need to make a report AND/OR get a copy of that video and apply for the copyright via the library of Congress. It’s online and not hard to do… it costs around $40…. that’s what I would do. Small claims isn’t expensive… you represent yourself, and so does she. I’d love to be a fly in that courtroom! Fucking explain this shit to a judge in civil court! In California, there’s a $10k limit… again, every state is different. But it may be enough to dissuade her from sharing.

This is highly illegal, and even if you consented (which I highly doubt) her sharing or blackmailing you doesn’t fall within the consent and therefore is a punishable crime as well. I will even bet that if push comes to shove and you present your facts before a judge she will also be on the hook for taking advantage of your drunken state. The same way a person can’t technically consent to sex when intoxicated, they can’t consent to being filmed having sex while intoxicated. You need to get her to confess to recording you and either get her to delete it or get police involved.
