If you have weed around and didn’t buy it for her, but she was able to access it, then the distinction is likely meaningless. This is something to discuss with your lawyer in more detail.

I’m not clear why you’re setting this as a goal. This should almost certainly not be a goal. You aren’t required to prove this. CPS is going to conduct an interview with you, not force you to prove that you didn’t buy weed.
The first thing I would suggest is that you make sure you don’t have any cannabinoids in your body in case you need or want a drug test. They can take days to weeks to clear. You don’t want weed anywhere near or in you right now.
It’s almost impossible to “prove” that you didn’t do something. You talk to CPS and answer their questions. They’re not just going to take her word for it, but the hospital is likely required to report it.
It’s important to keep in mind the hospital didn’t call CPS because they think you are a drug peddler – they are mandatory reporters for stuff like this.
CPS will come and interview you, this is not an inquisition.

You are not required to talk to CPS. And although you can give them permission to do a home inspection, you can also require that they obtain a search warrant from a judge first. Your 4th & 5th amendment rights don’t change because the state’s investigating agency is child protective services. It’s best to consult with an attorney about how you want to proceed.
Since the good legal advice has already been given I thought I would give some general advice. Make sure her regular therapist knows about the false report. Also, when she comes back home I wouldn’t mention it or if she brings it up just downplay it. If she knows this works to get under your skin she can and will escalate the false reports.
Definitely contact a lawyer. If you can’t afford to get a lawyer for the interview record everything. If you are in a single party state don’t tell them. If your in a two party state definitely tell them but don’t let them bully you into not recording. It’s to protect yourself. Never trust dcf.
All the good advice has been given already, but if it comes down to a urinalysis drug test, the best advice I’ve been given was “Don’t take a test you don’t know that you’ll pass”
Make sure you know exactly what you will test positive for before you pee in their cup. Take a test, consult with your attorney about the results, and figure out a plan from there.
You calm down and cooperate with the interview. The therapist did their job by reporting this claim to CPS. CPS is doing their job by investigating. Nobody is out to get you, both of these entities serve to protect your child. You say you did nothing wrong, and while that may be true, other parents/guardians do and have supplied their children with weed and worse. Just stay calm, answer the questions that are asked, and focus on this as another step to helping your daughter.
The sky isn’t falling and you don’t need a lawyer. The report was made by a mandated reporter and a CPS investigator has way worse shit to worry about than this. They are not going to believe a child in a psych ward over a responsible patent unless there’s a lot more missing from this story.
hi, Mando reporter here, I have been on both sides of the CPS call as a parent too. just roll with investigation, you obviously CARE about your reputation and it doesn’t feel good to have someone else ‘control’ the narrative. let them do their job and continue working on being the parent your kid needs.
