Hey there, it sounds like you’re dealing with a tough situation 😔. Dealing with a disruptive spouse in your business can be incredibly stressful and frustrating. In Illinois, you can actually serve a no trespassing notice to prevent your husband from entering your business premises without permission.
It’s important to remember that serving a no trespassing notice is a legal step, and it may not solve all of your problems right away. However, it can be a necessary first step in establishing boundaries and protecting your business.
Now, when it comes to serving a no trespassing notice, it’s crucial to follow the legal requirements outlined in Illinois state law. It’s advisable to seek the guidance of a legal professional to ensure that the notice is served correctly and in accordance with the law.
Additionally, communication is key in any relationship, and it’s worth attempting to have a conversation with your husband about the impact his actions are having on your business. Sometimes, individuals may not realize the extent of the harm they’re causing until it’s brought to their attention.
If your husband continues to disregard your concerns and the no trespassing notice, it may be necessary to pursue further legal action. Ultimately, your priority should be to create a safe and productive environment for your employees and protect the integrity of your business.
Remember, you’re not alone in dealing with these challenges, and seeking support from legal professionals and other business owners can provide valuable insights and guidance. Hang in there, and take the necessary steps to protect your business and well-being. You’ve got this! 💪🏼✨
Change the locks. Don’t give him the key. Remove all his belongings. Probably temporarily remove the couch and TV so if he does return there’s nowhere for him to get comfortable.
This isn’t really a legal issue though. If you have your own husband arrested for trespass, divorce is a likely outcome, so filing for divorce yourself is the most direct path using the legal system.
Pay someone to move all his stuff out of your space and in to X. Get a storage unit and put it under his name if you have to. Remove the TV and other things he does there that are not work.
Consult a divorce lawyer if your husband has so little respect for you and your business that he refuses to listen to you.
The legal advice: sure, you can trespass your husband from your business property (and also: get incorporated first, because a divorce will make this really messy).
Practically speaking: police and courts *loathe* getting in the middle of marital disputes. You are experiencing a marital dispute. You can be firm, draw a line in the sand, and enforce consequences if he crosses them, but know that everyone else involved is going to be really reluctant to help. The proper solution for when one spouse creates sufficient trouble for the other spouse that the police get involved is a *divorce*.
Divorce
Yes, you can trespass him.
My advice is to change the locks, give employees the new key, and get a lawyer.
You will very, very likely need to call the police to enforce the trespass, and they will likely arrest him if he refuses to leave.
Make plans for his stuff and how to get it to a space he has access to. DO NOT let him back in for his stuff. DO take TONS of photos of everything in the space before you serve notice and after to show the condition of the items I’m case he claims you damaged them.
Do not waste the time and efforts of the police. You want law enforcement to do your dirty work. As others have said, incorporate, then file for divorce. Also, move the couch and TV out of the break room until he’s removed. What kind of business are you running?
OP, either talk to a marriage counselor or get a divorce. It’s obvious you’re stressed by this child.
