Hey everyone, I need some advice on a sticky situation I’m facing. 🤔 My dad passed away without a will, leaving behind a collection of over 80 guns. His ex-wife, my step-mom, now has possession of them and wants to sell them without my consent. 😬 Here are the details:
– Dad passed away without a will, so everything is going through probate.
– Step-mom is trying to take all the guns to a consignment shop without my permission.
– Dad and step-mom divorced earlier this year, adding an extra layer of complication.
Now, I need to find a way to prove that the guns should be rightfully mine and not hers. 💼 Any suggestions on the best document to use to prove ownership and prevent her from selling them off without my knowledge?

Why are they yours? Shouldn’t probate determine who succeeds to the property in question?

If they’re divorced, she has no right to them anyhow.
You really don’t want to claim or sell the property of the estate until probate is settled. Get a consultation with a probate attorney in Alabama.
If there is no will then they aren’t yours. It all has to go through probate first. And if they legally divorced before his passing, there’s a chance she gets nothing.
I would call up the police, and complain about your ex-stepmother trying to fence stolen guns.
Can you go to the courthouse and get, marriage, divorce, and death documents?

My dad died this year and left a lot of guns. He was divorced and my sister is not his biological child. The police took his guns as they investigated his death and once I had my lawyer file for executor of the estate paperwork I was able to pick the guns up from the police. Obviously not a lawyer just wanted to share my experience, I wouldnt allow her to hold onto anything that you for sure want to keep.
