Hey everyone, so I’m dealing with a pretty intense situation at work and could really use some advice. Here’s the scoop:
– My co worker has been causing trouble at work, leading to an investigation for racial slurs
– After reporting racist text messages from the same co worker, I’m now receiving death threats 😧
– I’ve already contacted the police and they advised me to file a restraining order
Now, I’m wondering how HR will handle this situation and how I can navigate through this tough time. Any suggestions or similar experiences to share? Your advice could really help me out, thank you! 🙏🏽
Tell them what you said here. You’ve received death threats from a coworker, you’ve filed a police report and you’d like to have time/space separation from this person.
Once you get a restraining order, bring that in to HR as well.
You were right to call the police and recommend the restraining order as well, although they can’t do more?
Starting 7/1/24, CA employers are required to have a workplace violence program that addresses situations like these. HR should already be preparing for that and shouldn’t wait 2 more weeks to do something about it. It’s likely the program is already in place. Definitely let HR know and follow through with them on the program they have in place. [Here’s a summary of the new law](https://www.jdsupra.com/legalnews/looming-deadline-for-california-6909451/#:~:text=Starting%20July%201%2C%202024%2C%20California,safe%20and%20healthy%20work%20practices.%E2%80%9D).
HR should also be driving the investigation not only into the use of the racial slurs by your co-worker, but into the death threats. It should be a short investigation, since so much is in writing (the texts – hang on to them). We would terminate his employment. HR should alert the police to this, if they decide to terminate, since he has this history.
My best to you. Please let us know that things are okay.
100% share those death threats with HR immediately. He will likely be terminated very quickly.
