Storytime: I have a rare genetic disorder that makes fentanyl useless for me. Even after multiple warnings and written notes, the hospital still administered fentanyl during my surgery. 😑 My pain was unbearable, but no one seemed to believe me until my mom stepped in! 🤦♀️

Given that they repeatedly ignored explicit instructions not to use fentanyl and you suffered because of it, in addition to the evidence you have of that fact, it sounds like you might have a case. I recommend finding a lawyer who specializes in medical malpractice.
I’m so sorry this happened to you. But, as an attorney, I’m have to tell you that this would not be a successful malpractice case. It’s not because they didn’t do anything wrong – they did. It’s because you won’t be able to substantiate sufficient damages to support the incredible cost and time of litigation. Medical malpractice suits are expensive, expert heavy, and take a long time. I don’t want to discount your pain, but the lasting damages are hard to quantify (as opposed to the loss of an organ or paralysis or death, for example).
It’s possible that you could get some sort of financial compensation from the hospital and that is something that an attorney might be willing to help you do. As in, maybe your attorney would write a strongly worded letter that would prompt the hospital to cover your costs and some additional compensation for pain, but you need to know that if they refuse, it’s extremely unlikely that this would progress to a successful lawsuit.
As a surgeon this is garbage treatment of you. I am sorry for your pain and suffering. As ridiculous as this sounds next time bring a big sheet of paper with “DO NOT GIVE FENTANYL, MORPHINE ONLY” and have the nurses tape it to the front of the chart. Maybe bring a few copies. It saddens me that this is what I am recommending, but when things are unusual I have seen this done.
Brief temporary pain is worth essentially nothing as far as a malpractice lawsuit.
Not every medical error constitutes malpractice. There has to be damages and short term pain won’t count for that
