Hey everyone! 👋 So, I’ve been on FMLA for a while now and recently HR dropped a bomb on me – they want detailed information about my doctor’s visits. Like, super detailed. Is this even legal? Can they really ask for that level of personal information? 🤔 Here are some thoughts and possible solutions I’ve come up with:
– First off, it’s important to know your rights when it comes to FMLA and your privacy. 🛡️
– Review your company’s FMLA policy and consult with an employment lawyer to understand what information HR can legally request. 📝
– Consider talking to HR and expressing your concerns about the level of detail they are asking for. Maybe there’s a compromise that can be reached. 🗣️
– If you feel uncomfortable disclosing such personal information, explore options for filing a complaint or seeking external guidance. 📞
Let’s keep the conversation going – have you ever been in a similar situation or have any advice to share? Let’s support each other through these tough HR situations! 💪 #SupportEachOther #KnowledgeIsPower
You absolutely do not have to provide detailed information. But I’m wondering if you’ve exceeded your FMLA and that’s why they want a doctors note? All they need to know is that you were seen. They don’t need to know and you aren’t required to provide, any information about your appointment.
I’d be concerned this is an attempt to interfere with your rights to FMLA, which is illegal.
Have you asked them specifically under what measure of the FMLA they’re asking for this information?
You don’t need to provide this information. However… Has your FMLA been intermittent or have you been out of work continuously?
I’m wondering if your FMLA has been exhausted. You only get 12 weeks. If your FMLA is exhausted, the situation is COMPLETELY different, and you are going to need to play ball with your employer.
If you’ve exceeded 12 weeks you are no longer on FMLA. Regardless, they aren’t entitled to this level of detail.
PWFA is on your side! The pregnant workers fairness act just went into law one year ago. They shouldn’t be messing with you nor can they ask for detailed notes from your doctor’s visit. PWFA protects you and helps you with any needs during your pregnancy.
This information should be protected by HIPPA if I remember correctly.
They’re most likely asking in order to prove that you don’t deserve the FMLA because you are not pregnant or not high risk, or something like that.
It is absolutely a violation of your rights for them to request detailed information about your medical history.
Was your FMLA for pregnancy or something else? I’m wondering if they’re trying to get updated FMLA information.
But as everyone else said- the level of detail they’re requesting is unnecessary. They would just need dates and restrictions
Ummm no. Your medical appointments are no one’s business. You are on certified FMLA, certified by your doctor. That’s all that is needed. That they are requesting detailed medical appointment information is not ok and it’s gross
Yeah no that is not okay. A doctors note that toy have been seen is reasonable but asking for detailed information on what the doc found or spoke to you about is so incredibly inappropriate. Not sure if HIPPA applies here but I would argue it does. I have no idea in the world why your company would want detailed information about your doctor visits but I am extremely uncomfortable reading this request.
When I ask for FMLA all I want to know is it a serious health condition or not? Spare the details. Were you out 3 days or more, or had an overnight stay and does your doctor want you out on a continuous leave or intermittent?
Def not! That’s hippa protected. They’re in violation of it. All your company needs is the dr note stating “fmla for … reason” That’s it.
