You don’t even have to have HR. They often make the president or another executive the only option to go to when is a small organization.
I’d be more worried about what’s illegal rather than what’s unethical.
Not illegal, not entirely ethical either. Had this question come up when my husband became CEO of the company he worked for. They needed an HR person and since the team knew that’s what I do, they asked him about bringing me on. His answer was no. HR is supposed to be there for the company AND the employees, who would they be able to go to if the complaint was against him? That’s the issue here, no one will trust HR because of this.
At the end of the day HR is there to represent the companies interests, and not the employees. Sometime that means they side with employees to avoid the company being sued or investigated criminally, however their boss is the company, not the employees. So it doesn’t matter if they are the wife of the President or even in some small companies another hat the President wears. In this situation if you want to make an issue of it, you need to talk to your state Labor Relations Board, and see if the state is willing to enforce. Yes, retaliation is illegal, but unless they blatantly say they are retaliating in writing it can be difficult to prove.

I’ve never met an HR rep that doesn’t immediately run to the president of the company to relay exactly what’s been said even if they’re not sleeping together. Perhaps you’re lucky that it’s obvious, most people get burned by not realizing that’s how it works.

If they can operate without bias then it’s fine . But to be honest , they would talk over dinner and President would know all the HR “confidential” items
It’s perfectly legal. If they aren’t publicly traded and/or don’t have a board of directors or governing oversight of the like, it’s not even subject to a vote. This is literally how family businesses run. Nepotism clauses can be maneuvered around by building in additional layers in the reporting structure if that happens to be challenged.
Ethics are always up for debate. Chances are if someone doesn’t have an issue within the company, ie, everyone loves you and you benefit from that favor, ethics wouldn’t even be a topic of discussion. It’s all subjective.
Illegal? No. Unethical? Undoubtedly. Common? Yup.

Not illegal, not necessarily unethical. It just sounds like she is a terrible HR person.
The condition of marriage doesn’t automatically make it unethical, but it does significantly increase the risk of conflict of interest, which is what sounds like happened here.

Most certainly not illegal for them to be married. Ethical? Probably not. But since it’s not illegal, it doesn’t really matter. If the employer is adopting illegal business practices (such as wage violations), then file a complaint with the labor board in your state.
LOL. I’ve witnesses conspiracies to defraud the company between the head of HR and the president, who were both married and having an affair.
What should be done? Does the president own the company outright? if yes, then quit if you don’t like. If no, then you can go to ownership. It’s unlikely they pick you over the president though, and you might end up fired. So, if you don’t like it, probably quit for your own self-preservation. quitting looks better.
