📦 Dealing with a situation where your neighbor is keeping a package addressed to you can be frustrating and confusing. You may be wondering if there are any laws in Michigan that deal with this type of situation, or if this could be considered theft. In this article, we will explore the details of your predicament and provide you with some possible solutions.
## The Situation
FedEx delivered your package to your neighbor’s house six doors down, and despite your efforts to retrieve it, they have not returned it to you. Here are the details:
1. **Contact with Neighbor**: You have approached your neighbor in person and left friendly notes on their door asking for the package back, but have not received a response.
2. **Proof of Delivery**: You have received delivery confirmation from FedEx along with a photo that clearly shows your neighbor’s address. Additionally, you have contacted FedEx and they have confirmed that the package was addressed to you and had your name on it.
3. **FedEx Support**: After opening a “case” with FedEx, they only sent you an email stating that the package had been delivered and did not offer any further assistance.
4. **Value of Package**: The package contained over-the-counter hearing aids that were priced at $395 before sales tax.
## Legal Considerations
### Michigan Laws and Package Delivery
In Michigan, there are specific laws that deal with the delivery of packages and the responsibilities of recipients. Here are some key points to consider:
1. **Theft**: Under Michigan law, knowingly keeping someone else’s property without their consent may constitute theft.
2. **Delivery Confirmation**: If there is clear evidence that the package was delivered to your address, you have the right to expect it to be returned to you.
## Possible Actions
### Contact Local Authorities
If your neighbor continues to keep the package despite your efforts to retrieve it, you may consider reaching out to local authorities for assistance. Here’s what you can do:
1. **File a Police Report**: If you believe that your neighbor is intentionally keeping your package, you have the right to file a report with your local police department.
### Legal Assistance
In cases where informal attempts to resolve the situation with your neighbor have failed, seeking legal assistance may be necessary. Here’s what you can explore:
1. **Consult with an Attorney**: Speak with a legal professional to understand your rights and options in this situation. They can provide guidance on how to proceed and may assist in pursuing legal action if necessary.
### Escalate with FedEx
Given that FedEx has not adequately addressed your concerns, it may be worthwhile to escalate the matter with the company. Here’s what you can do:
1. **Speak with a Manager**: Request to speak with a FedEx manager and provide them with all the relevant details of your case, including the proof of delivery and communication with your neighbor.

Keep pursuing FedEx and request that the seller refund or re-send. Take screenshots of the fedex delivery confirmation/photo and include with dispute to your credit/debit card or the payment service you used.
Go after the company which sold you the hearing aides. Don’t get into an argument about the neighbor keeping it or issues with FedEx. Simply leave it at. They were not delivered to your address and you want a replacement or a refund. If they still won’t do it. Do a chargeback and cite that the items were not delivered to your address.
FedEx was their shipper, not yours. Any problems with the delivery are their problem with FedEx not your problem. Yes, the neighbor is in the wrong. Yes, FedEx is a pain. Neither is your problem. They are the seller’s problem.
I believe the sender is responsible for contacting FedEx to engage any type of insurance that can cover the “loss” of the package. Take your neighbor out of the equation when pursuing the sender. Just let them know you never received the package.
IANAL I see you have already contacted the seller and FedEx without any progress. I would suggest one last contact to the seller asking for help, and letting them know you’ll be forced to open a dispute with your financial institution if they can’t assist. You will want to advise your bank that you’d like to file a claim for an item not received when taking that step and they will investigate. Be sure you keep the photo of the item at the wrong address to submit, along with any correspondence to the seller and FedEx.
Is there a chance a 4th party could have stolen the package from the neighborsdoor step? Maybe the neighbor is like “What package” and is just ignoring cause they think you got the wrong neighbor.
Either way, contact vendor and FedEx and demand resolve.
Also, you may want to consider a po box or maybe if you have an employer that is agreeable to packages being delivered, you could go that route. You can also do pick up at fedex location.
Good luck!
If you paid by credit card, dispute the payment as not received and you have proof it was delivered to another address that is not yours and the company refuses to work with you on it. Request refund in the full amount. Then when you get your money back, go buy them elsewhere.
Been through this. Your neighbor can’t legally keep a package not addressed to them, but you will never ever be able to prove they actually have it.
At the end of the day, the carrier lost it. File the insurance for a lost package. It’s not your responsibility to recover a package they left at the wrong address.
Note: go easy on the neighbor because there’s a chance they don’t have it. Sometimes the carrier will deliver to the wrong house and take the photo, then the mistake gets realized, and they come back and get it. So however small, there’s a chance the neighbor doesn’t have it and knows nothing about it. Being that it’s hearing aids and not something cool like an ipad, I would say the chances are higher that this is the case.
Go to the merchant and report the package as not delivered. Go to fedex and do the same.
If its a merchant item, the neighbor can keep it as its misdelivered merchandise. even though people dont like hearing this.. the law that protects mail aplies to USPS not private delivery services.
Contact your state AG. Your package contained necessary medical devices. The bad publicity for FedEx will hurt them
If you get a package that’s not addressed to you, isn’t that considered theft? I’d stop payment on your credit card and let the company you purchased from know
