So you find yourself in a frustrating situation – you sold your Sony ZV-1 camera on Mercari, only for the buyer to claim they didn’t receive the items they were supposed to. You then stumble upon videos on YouTube and TikTok showing the buyer happily flaunting the exact camera they claimed they didn’t receive. What a headache! 😫 But fear not, there are steps you can take to navigate this sticky situation and hopefully get the justice and compensation you deserve.
Let’s break it down:
### Evidence is Key
Your first step was to gather as much evidence as possible. You’ve got screenshots, recordings, and possibly even the UPS store’s video of your item being packaged and sent off. This is excellent groundwork and will serve as proof of the actual situation should you need it in a legal sense.
### Contacting Mercari
You’ve reached out to Mercari support and they’ve approved the return, which is disheartening to say the least. However, keep pushing – provide them with all the evidence you’ve compiled and make it clear that you have substantial grounds to contest the return. Be persistent in your communication and don’t be afraid to escalate the situation if need be.
### Legal Action
You’ve reported the incident to the IC3, the cybersecurity branch of the FBI, which is a step in the right direction. If Mercari continues to brush off your claim, you may need to seek legal advice and consider taking the matter to small claims court. The evidence you’ve collected will be crucial in supporting your case.
### Law Enforcement
You’ve already taken the initiative to contact the Detroit Police and file a report. It’s also wise to reach out to your local police department and provide them with all the evidence you have. It’s important to exhaust all possible avenues in seeking justice.
### Community Support
Utilize online communities and platforms to share your story and seek guidance from others who may have experienced similar situations. The power of social media and community support should not be underestimated.
### Resolve to Stay Strong
This is undoubtedly a frustrating and disheartening experience, but it’s crucial to stay strong and resolute in seeking the compensation and justice that you rightfully deserve. Document every step you take, every conversation you have, and every piece of evidence you collect.
### Conclusion
The situation you find yourself in is undeniably challenging, but with the evidence you’ve gathered and the steps you’ve already taken, you’re on the right path to seeking fair compensation and justice. Garner support from the online community, persist in your communication with Mercari, and be prepared to take legal action if necessary. Remember, you’re not alone in this – there are resources and people out there who are willing to help you navigate through this. Good luck! 🤞🏼
You might have a claim with UPS, if they packaged it and then it didn’t arrive (allegedly). Assuming you paid for the shipping insurance, UPS should pay you for the item, then they will investigate to find where the camera ended up. Otherwise your only option would probably be small claims court, which would probably be a pretty easy win with all the evidence you have. Of course, you would have to file in “Sally’s” jurisdiction, which probably wouldn’t be worth the travel cost.
Side note, did the camera have a serial number that you could use to prove it is yours?
For additional evidence, figure out your camera’s SN and then harvest everything Sally posts and check the metadata for your SN. If you find one, make sure the wayback machine has a copy. If nothing else, check the metadata of your own images to get the SN.
It’s going to be an uphill battle getting Mercari or any police to care about this, and as others have said, small claims court would likely side with you, but at what cost. You could always put together all the evidence you have and bluff about any or all of those routes if they don’t cancel their claim and hope for the best.
Regardless, good luck.
Definitely ask if that buyer has had previous claims about their other purchases. They might do this frequently.
