Hey everyone! 👋 Have you ever dealt with unpaid super from a previous employer? I’m in a bit of a pickle with the director of my gym in Sydney who sold the assets and declared bankruptcy, leaving me and others without our super back pay for over 5 years!
Here’s what’s been going on:
– The ATO has placed a garnishment order of 15% of the membership fees until the total tax and super debts are resolved (which could take over 12 years 😱)
– The previous director sold the business through an asset sale, and the new owners were aware of the massive debts
I’ve been trying to get the ATO to send me a letter with the amount owed, but no luck so far. Do you have any advice or suggestions on what I can do next to secure my super?

One of my mates found themselves in the same position. Magistrate ruled in their favour. Business was ordered to pay Super. Business hasn’t paid Super. It’s been 3 years.
Sorry but if you didn’t get super for 5 years and kept working there then it’s your fault.

The director can be issued Director Penalty Notices by the ATO and have the superannuation recovered from him personally.
Worth reading up on that and asking the ATO whether they have done this. It is a very common way to recover unpaid superannuation.
