🤔[TX] Was I terminated? Can I file for unemployment? 🤷♂️
Four weeks ago, I told my employer I was relocating out of state. Initially, they said I could work remotely and even announced it to the team. However, things took a turn recently. Here’s what happened:
– Initially told I could work remotely
– Later told it was no longer an option, but given two months to find a replacement
– Requested terms for staying on including PTO payout and retention bonus
– Terms were deemed unacceptable and trust was lost
– Informed my last day is today and to return all company property
So, what now? 🤨

Yes, your employment has been terminated. You don’t have to sign anything (if you did, then someone could avoid ever being terminated by simply refusing to sign anything).
You’ve been informed you’re done end of day and turn in your badge. You’ve been let go.
You don’t have to sign anything. They don’t have to give you paperwork. You need to return their property to them.
Your employer is probably not registered to do business outside of Texas and cannot legally continue to employ you. They probably said “okay, cool” and then legal or operations or HR or someone said “yeah, no, can’t do it.”
You probably could have kept working those 2 months but you overplayed your hand and they had a contingency. It happens. 🤷
You can file for unemployment, but it’s not clear you’d qualify. Since you’d still presumably have a job if you hadn’t moved. Doesn’t hurt to file and see what TWC decides.
You don’t have to do anything in writing, in terms of resignation.
It’s going to come down to who the state of Texas believes. I have my money that they will believe your employer. Since you gave them an ultimatum and demanded more money plus a bonus.
Reminder that unemployment, like all other insurances, don’t want to pay out claims if they can help it.
You’re also moving out of state, which the employer will say in their response, showing you always intended to quit.
Yes you’re terminated. Yes you can file for unemployment. You don’t have to speak to anyone specific or sign anything to be fired.
No, you resigned and they accepted your resignation a few days early. In your post that you deleted (but a few comments of yours still remain), we warned you about asking for everything you did. You found out.
