I feel like she may not have given you all the information. He may have called the police, but the police determined while speaking with her that she was threat to herself, and/or others.
Unfortunately, it is way too easy to Bake Act someone in FL. It is entirely plausible that she was taken solely on the ex’s word. I worked inpatient psych for 6+ years and have seen this exact situation play out often.
That being said, a patient will see a provider within 24 hours. If the provider determines that the patient is not a risk to themselves or others, they will discharge them. It seems that this is what happened.
Her ex just committed domestic violence via using the Baker Act. That needs to go in the restraining order
Incorrect. Her husband cannot baker act someone. A law enforcement officer can. And they must make their own determination of the criteria. The police officer who felt she met the criteria for an involuntary hold and mandatory psychiatric evaluation is the one who baker acted her.
OP, you likely don’t have the full story. The police report will have its own account of the situation. They just individually assess that the patient is an immediate risk of harm to themselves.
