Seeking Guidance After Son’s Injury
Last week, my family was in a devastating car accident caused by a drunk driver with diplomatic immunity. She is shielded from prosecution, leaving my 7-year-old son with serious injuries. Here’s our story and our struggle with injustice.
Options to Consider:
1. Seeking Legal Support
2. Contacting Local Authorities
3. Exploring Diplomatic Channels
Any advice or insights on navigating this difficult situation are greatly appreciated.”
Talk to a personal injury attorney.

If that sports car was rented, then go after the rental company. THEY have insurance and no diplomatic shield.
I am not talking about the insurance that a renter can buy or decline at the time of rental. I am talking about the insurance that any entity must have in order to be allowed to rent out vehicles. I.e. sue Hertz, not the driver.
If the boyfriend has his name on any of the rental paperwork, you should be able to go after him as well.
As others have said, tell your story to a personal injury lawyer. They should jump at this. If you do not like the vibes of the first lawyer you speak to, you are allowed to ‘shop’ for one that you prefer.
Most good lawyers would take this case with no big fees up front, and get paid when you get money. Just watch for lawyers who ask for too large of a cut of your awards/settlements.
It might be helpful to let us know where this happened (DC, NYC, etc). I would think that the laws of where it happened apply, not the laws of where you or the driver live.
Your first step is speaking with an attorney as others correctly suggested. But I would also offer a recent example of a diplomat’s child who also committed crimes in the US while claiming diplomatic immunity, but the immunity claim was rejected by the court and they proceeded with prosecution anyways.
A few months ago in Miami, the son of an Israeli Consul, Avraham Gil, age 19, was arrested after driving recklessly, ignoring officer commands, and running over that officer with his motorcycle. He faced two felonies in Florida but his lawyer immediately claimed diplomatic immunity at his initial hearing, prompting the court to pause the trial. However after this initial pause, the trial resumed and moved forward after the US State Department issued the following statement:
“The Department is aware of this incident. We can confirm that, as the dependent of an Israeli consular officer, the concerned individual is not entitled to civil or criminal immunity.”

Uh, diplomatic immunity doesn’t cover serious traffic violations. Talk to a lawyer.
Get the best lawyer you can afford, go after the rental car company, that’s how you get her.
Two words: lawyer. Now.
First, as others have mentioned, rarely do the children of diplomats given immunity, even diplomats themselves can have it rejected if the crime is egregious enough.
Secondly, even if she had some form of immunity, the car has an owner, that owner, the boyfriend, rental car company ect could be determined to be partially responsible for the situation and persued for your damages.
Third, since there seem to be injuries if you don’t know where to begin, you’ll likely wat to find a lawyer, i’m not sure who told you about her having immunity, but it goes without saying, don’t take legal advice from your opponent…
Fourth, try not to discuss material facts about the case outside the bounds of attorney client privilege, especially things like the extent of injuries ect, especially on the internet where it is certainly discoverable.
Lastly, good luck. Obligatory, not a lawyer, not your lawyer, this is opinion only, ect.
The daughter doesn’t have diplomatic immunity.
Wow I’m very sorry that happened to you. I hope she is held accountable and that our government acts competently and considers recalling her father if he can’t keep his household in order.
Speak to an attorney because there is a fair chance that her father’s diplomatic immunity won’t extend to her, especially if it’s that egregious. Ask your lawyer, but you may be able to lodge a formal complaint against the diplomatic mission and force the Mexican government to act properly (good luck).
I wish your family the best and for your son to make a full recovery.
Call a PI lawyer. Let them handle it. Focus on getting your son the medical treatment he needs and let the lawyer handle the rest.
Diplomatic immunity does NOT protect from civil suits. Get a lawyer and sue her for millions.
Might be immune from government, but possibly not personally. Talk with a lawyer.
You might be able to get the money out of the rental car’s insurance company. Idk about other states but in Maryland all drivers are required to have auto insurance and all rental companies as well.
If all else fails, go lethal weapon on him.
