#WorkplaceAssault #SexualHarassment #Unemployment #EmployeeRights
Hey everyone,
I need some advice and support. I was sexually assaulted by a coworker at work, and when I finally mustered up the courage to tell my boss, I was fired the next day. Here’s a quick rundown of what happened:
– I was assaulted by a coworker who I considered a friend in the office 🚫
– I told my boss about the assault, and he said he couldn’t fire the coworker to avoid paying unemployment 🤯
– The next day, I was fired for “poor performance” and my boss is now contesting my unemployment benefits 🤬
I feel like I’m stuck in a completely unfair situation. Does anyone have advice or experience with something like this? I would really appreciate any guidance or help you can offer.
Thanks in advance for your support! ✨
In my opinion, seeking legal advice from a lawyer who specializes in employment law could be a step in the right direction. They can guide you through your rights and options in this situation. Don’t hesitate to reach out for professional assistance.
Get a Lawyer, take them to court and tell the SA to the police.
“Poor performance” is not a legal reason to withhold unemployment, even in At-Will states.
Did you tell your boss what happened in writing/email? Or…in person?
Get a lawyer
Use this time to gather all evidence you have of what happened and write down all dates and times with as much detail as you can asap. See a lawyer. Do not wait. Your prompt action will be a consideration. If you delay getting legal help the question will be asked why. Sorry this happened to you. Good luck.
Where did this happen, i.e. what country and state if in the USA.
>The next day I was fired. I was in the office taking a break (we don’t have a break room) with my shift covered. Boss calls and says I’m fired for being in the office.
Have you or other employees been in the office before on breaks without being fired? Are there any workpalces rules about not taking breaks in the office?
It’s generally unlawful in the USA to fire employees in retaliation for complaining about sexual harassment.
You can complain to the EEOC or contact a local employment lawyer.
Is there any chance the boss is having a relationship with her, or wants to, and thus fired you instead of her when he heard she came on to you? Because this is pretty unusual that you would be fired after reporting something like this.
