#PaycheckNightmare #HelpNeeded #LostCheck
Hey there, I can totally understand your frustration and anger about this situation. It’s definitely not fair for you to have to wait so long just to get the money that is rightfully yours. Here are some steps you can take to hopefully resolve this issue and get your money back:
1. First, make sure to stay in regular communication with your employer about the situation. It’s important to keep them updated on your concerns and make sure they are actively working to resolve the issue.
2. Ask your employer to provide you with a copy of the cashed check and any documentation related to the situation. This will help you to have the necessary information if you do need to file a dispute with the bank.
3. If your employer suggests having the person who cashed the check send you the money through a cash app or write a personal check, make it clear to them if you are not comfortable with these options. It’s important to prioritize your safety and security when dealing with financial matters.
4. You can also reach out to the bank where the check was cashed and inquire about their dispute process. They may be able to provide you with guidance on how to proceed and what documentation you will need to submit.
5. If your employer continues to delay taking action to resolve this issue, you may need to consider reaching out to a higher authority within the company or seeking legal advice. It’s important to advocate for yourself and ensure that your rights are being upheld.
I know it’s incredibly frustrating to have to deal with this kind of situation, but it’s important to stay persistent and assertive in advocating for what is rightfully yours. Don’t hesitate to seek support from friends, family, or even a professional who can provide guidance on the best steps to take.
I really hope this situation gets resolved soon and that you get the compensation you deserve. Keep pushing for a resolution and don’t let this discourage you from seeking fair treatment in the future. You’ve got this! 💪🏼🤞🏼
Does your state have a decent department of labor?
They need to file a dispute because this is a them problem not a you problem.
They also need to cut you a new check ASAP before you contact the labor department.
I work in an accounting department at a hospital, this is a thing that could have been solve in 1-2 days tops. Also, they are feeding you lies about needing to wait. They need to cut you a check today.
The fact that their bank didn’t flag the check as a positive pay exception is very suspicious considering the payee name mismatch.
If you can wait, it might pay off to establish a paper trail where they state that they didn’t pay you and are waiting on something before doing it. Then wait. When they finally do, file a claim for delayed wages and enjoy.
Here’s the thing, no judgement but I’m sure your single paycheck isn’t six figures, they have the money to cut another check they are just bullshitting you. And if they legit don’t have the money to cover one additional paycheck while they clear it up with the other person, then run!
Are you classified correctly as a 1099 employee? I would figure that out after this gets sorted out.
Legally they must pay you within X amount of days. A very short time compared to the months they are telling you.

This is a them problem like others have said. Don’t let them make it a you problem.
Call your department of labor, file a formal complaint, when you have done that, tell them via email you filed the complaint and they’re legally required to provide you with a replacement check.
They gave it to the wrong person who stole the money. That’s on them, not you.
A two month wait is unconscionable.
No, they need to pay you, and not whoever they gave your check to
I’d give them 24 hours before filing a wage claim with your state (or federal, if your state lacks one) DOL
Check your local labor laws. In CA where I live you are entitled to a penalty of one day’s pay for each day that the wages are late up to a maximum of 30 days.
Getting it back is their problem, paying you on time is their problem. You do not have to wait – report them to labor board.
Their mistake is not your responsibility. Neither is their accounting, nor the fact that whoever they gave it to was able to deposit the check. Their payroll was taken, while it was under their control. You are absolutely owed your pay regardless of any of that. This is a them problem and trying to make it a you problem is illegal.
They are contractually obligated to pay you.
They didn’t pay you.
They are in breach of contract.
In any case: issues with wages paid is a red flag in any company for liquidity issues
No. That sounds like a company “you” problem. They owe you the money. Tough tiddies they wrote to wrong person.
Call the Dept of Labor if you have one.
Let your work know you’ll be filing a wage claim since they gave your check to someone else and are refusing to pay you for their mistake.
That a them problem not a you problem. Tell them to immediately issue you a check it you will be filing a complaint with the NLRB.
Nope. They need to pay you and you were NOT paid. You didn’t lose your check, it didn’t get lost in the mail – they opted not to utilize any security measures and it resulted in YOU not being paid. They can get their $80 back from the person who mistakenly/fraudulently cashed it.
At this point I’d just file a claim with your state’s department of labor.
Contact the labor department. This is not your issue. You have not been paid so they own you. In Some states they have to pay penalties.
“Hello, State Labor Board? I have a situation of not being paid promptly by my employer due to an error they made. Can I speak to someone about this?
I see you are replying to comments that you are classified as 1099 contractor. The reason everyone assumes you are a W-2 employee is because you refer to your “part-time job” and your “~~pay~~check”. Technically, they are your client and they haven’t paid out for your contracted services (invoice).
For anyone else reading this. Labor department and any related services are not an option since OP is not an employee. Small claims court would be the only option
Your employer is lying to you and committing criminal fraud in the process.
Get them to put all their sketchy bullshit in writing by whatever means, text, email, etc. If they tell you something verbally, send a follow up email immediately asking them to confirm what they told you verbally. Get their asses documented. Then get a claim filed with your state’s employment regulatory agency. They are stealing your wages. Do not put up with it. They are acting criminally here.
They have to pay you. They can’t do this. They made the mistake, therefore its their fault and their liability to fix it.
OP, this sort of sounds to me like they’d rather force you to deal with other guy. This is the employers mistake, not you or the other guy. Work needs to secure paychecks, and they need to pay you out of pocket while they fix the issue, even if that means cash out of a register. That’s the only acceptable solution.
You dealing with the other guy opens both of you up to a myriad of problems. If things go south between the two of you, the employer can easily fire one or both of you and then try to just forget about it. This may be what they want, just to wash their hands. Whatever this bass-ackwards check distribution system is, it’s wrong and needs to be fixed. I would honestly demand payment and i wouldn’t work another payment until I got it, I’d spend my time at work calling state employment regulators to report them.
They can absolutely give you a new check and put a stop order on the last one. This is pure laziness on their part.
Working without pay is illegal. The ability to pay you falls on your employer and any excuses would be something they need to address after making sure your paid. Tell them you’ll call the department of labor and see what they think.
