Can I legally move someone sitting on my car?
#carownership #legalrights #trespassing #personalproperty
If you find someone sitting on your car, you may wonder about your rights and how to handle the situation. Here’s what you should know:
Understanding Your Rights
– As the owner of the car, you have the right to control who can access it.
– Trespassing on personal property is against the law in most places.
How to Handle the Situation
1. Politely ask the person to move off your car.
2. If they refuse to comply, you may need to involve law enforcement.
3. Avoid using physical force unless absolutely necessary to protect yourself or your property.
Remember, it’s important to stay calm and handle the situation with caution to avoid escalating the issue.
By being aware of your rights and handling the situation tactfully, you can effectively deal with someone sitting on your car.
No physical contact at all. Call the police or any authority if they won’t budge.
Eeeehhhhhh,
I wouldn’t recommend it. Touching someone without their consent is Battery.
Maybe, maybe, you’ll be able to convince a court/jury/the cops that your actions were justified in the defense of your property.
But, that means possibly going through all the headaches and court and issues in the WORST CASE scenario.
Much better to let the other person damage the car and then get THEM in trouble for property damage. WAY less risk
If you live in a stand your ground state, you can do a hell of a lot more than that, as it should be.
Depends on what state you live in.
hypothetically, what happens if someone sits on your car, you ask them to move, they don’t, and you proceed to drive your car as if they weren’t there? what does the law say about this?
Touching someone without their consent is a battery, not assault.
Touching them in a way that makes them afraid you are going to seriously injure them would be assault and battery.
You’re generally allowed to use *reasonable* force to prevent or mitigate the consequences of a crime committed by another, so if someone is impeding your lawful ability to move you can generally use the minimum necessary force to prevent them from blocking you.
By law? No.
Unless you feel threatened, then it can rise to self defense and depending on where you live, that opens a lot of options for you.
Fun fact though, preventing someone from leaving is false imprisonment and can easily become a felony. So don’t ever block someone from leaving.
Just call the police.. they’re committing a crime, so either the they get off before the cops show up or they are made to get off.
I mean, regardless of legality, some idiot is sitting on my car and won’t leave, they’re gonna be tasting pavement pretty quick.
Being a nice guy has gotten me nothing but burned in this world. I’m done with it.
Slowly inch forward until your in the spot then park and leave. When they get aggressive in most states you can use lethal force then they’re no longer a problem!
You could potentially get in trouble if things get physical. It’s best to just call the cops on them.
Rule #1 you didn’t act intentionally to cause any harm to anyone
If someone is fully sat on your bonnet-reverse quickly if you can, they’ll fall and you won’t have ran into them
Probably best to just blast Yoko Ono music to annoy them, then call the cops.
Lay on your horn.
Worried about them damaging your car? Just wait until you’ve gotten physical with them and took the spot they felt entitled to. When dealing with stupid or crazy the best thing you can do is move on. You’ll waste more time and be more stressed dealing with them than you would finding a new spot.
Turn off the car. Tell them you have run out of gas. Ask them to help you push the car into the parking spot.
In texas you can shoot them.
Not advocating for that, just sayin
They will move regardless of whether or not they want to, once you’re inside and pop that bitch in reverse with your foot on the gas.
They can’t even sue you for injuries after. Because you told them to get off your car before you pulled it out from under them at top speed.
Like you don’t even have to actually touch them at all. Or speak to them past simply saying: GET OFF MY CAR. Once you say that? You just have to get in your car and go full reverse as fast as your car will allow you to.
You can not be held responsible for what happens to them after. You warned them. It’s your personal property and not theirs. They refused to move and were a bit threatening no? You maybe felt unsafe yes?
Don’t try to move them. Just start your car and start driving. If they don’t want to be seriously injured? THEY WILL MOVE OFF.
But why *can’t* someone stand in a spot for 2 mins to save it?
Are y’all that crazy these days that you’ll literally fight/consider violence over a parking spot?
Ridiculous.
Call the police for damage to property and record them.
No, call the cops instead.
Most likely, just pulling out your phone and threatening to call the cops on them will make the asshole get out of the way.
Assuming that you have a smartphone, just start taking pictures of the person sitting on your car. Be sure to get a clear picture of their face.
Then start your engine, and call the police.
Make sure that your doors are locked and the windows are closed.
Chances are, they will move along in a big hurry.
Depends what state you’re in. In some, your car is an extension of your home.
Physically? yes of course. Use the pedals. Legally? That’s a big time gamble with life altering consequences if it doesn’t go your way.
Just let it go. It’s not worth it. You risk actually hurting her by accident and if you’re a guy, anything she says could be used to criminalize you in some way because that’s just the way the world is.
She’s completely in the wrong but it just ain’t worth it brother. She ain’t your wife, your girlfriend or your mom. Park a little further and just walk the extra 10 seconds to avoid crazy.
It’s probably a bad idea. You could get into trouble for it so it should be a last resort
Anything you do could result in an encounter with law enforcement, physical injury to yourself, or both. Even if you’re legally justified, that’s going to be cold comfort if you spend weeks or months dealing with the fallout of some idiot picking fights in a parking lot.
Idiots don’t have enough impulse control to care about jail or physical injury, and they’re not likely to pay their medical bills anyway.
You have to yell “hey fuckstick, get off the fuckin’ car!” and then do the man dance.
