Hey everyone, I need some advice and guidance. 🙏
So, here’s the situation: my family member has celiac disease, has been hospitalized in the past due to complications, and is now in a mental health facility. But here’s the kicker – the nursing staff at the facility are not accommodating her gluten intolerance at all. 😡
We’ve brought in certified gluten-free food for her, but they refuse to give it to her. They keep serving her food that contains gluten, despite knowing her condition. 🤦♀️
I’ve heard that celiac disease is considered a disability under the ADA, so I’m wondering if what they are doing violates any laws. Has anyone had experience with this before? Any advice on how to handle this situation?

You need either the hospital’s ombudsman or an attorney to assist you in having your family member’s medical needs addressed, or have her transferred to a hospital that will.
Also if it helps, with celiac’s, if you keep consuming gluten it can possibly kill you. The proteins in the digestive tract attacks itself. Its why its an autoimmune disorder.
You can fill out an ADA violation report online. It’s not very difficult- I’d ecommend this, because if they are doing this to your family, they are doing it to others. Those people may not have family members to stand up for them.
It may be worth a complaint to the Dept of Health too. They handle a lot more than you think within health facilities. Seems like they are due a visit.
Did she voluntarily check herself in? Does she have a hold order in place? They don’t let it be known, but if she voluntarily checked herself and they did not follow through on a hold, she can check herself at anytime. Sounds like she definitely needs the help but not at the cost of her physical health as well.
