Hey everyone! I could really use some advice on a labor law issue my stepson is facing in Ohio. Here’s the situation:
– Stepson is an HVAC Technician in Ohio, making 58k per year
– Was promised PTO for hours worked over 50 per week, but has received neither PTO nor overtime for over 90 hour weeks
– Job involves physical labor, travel, setting up clean rooms, and maintenance work

We would really need his actual JD to do a FLSA determination on. If you believe he’s been misclassified, HE can file a claim with the state for unpaid wages.
Since when would an HVAC tech be salary? That doesn’t sound right? Does he have supervisory responsibility? Can he hire or fire people? I work in the trades and I have never heard of someone in the trades being salary (except supervisors). DOL has a test you can look at whether or not you should be a salary. You can’t take a person who should be hourly make them salary to avoid paying overtime.

Based on the info. you have provided he should be classified as hourly non-exempt and should be paid overtime.
Not even close to a position exempt from OT pay
