Hire an accident lawyer.
Personal injury attorneys usually take around 35,%of settlement and nothing if they lose. They usually won’t take on a client if they don’t think there is an extremely high chance of a decent settlement. But you’re saying you have no significant injuries so I doubt you have a case. Hope he has insurance, that way you can get money for your car.
Like the other poster stated, if you don’t have significant injury that would keep you from working you won’t get much. And 35% goes to the lawyer so you will get even less.
I was in an accident that caused me to lose my job and I was awarded 120k .
Insurance will cover the cost of your vehicle, but minor whiplash isn’t significant enough to get much else
I would get an injury attorney. Yes, they will take about a third of your settlement, but they also will negotiate all of it on your behalf. You may feel that you are okay right now but tomorrow you may wake up hurting like heck, or next week, or next month. Injuries are funny that way. It likely will take just under a year to fully be settled. It’s unfortunate that it happens like this. Your insurance can do the negotiating and fighting on behalf of your vehicle being destroyed, the injury attorney will work your personal case which is where you will get the most ‘compensation’.
speak with a lawyer
definitely get checked out by a doctor because what you are feeling a few hours after the accident might not be everything. you will likely be very very sore/stiff tomorrow and it’s just good to get checked out even if nothing horribly wrong with you.
What state did this happen in?
You will get what your car is worth.
Stop posting. Go to the ER and get checked. The adrenaline response could be masking injuries, especially related to head/spine. Follow up with your regular doctor, as he may refer you for further testing.
It is possible for you to have a lifelong injury/impairment, regardless of how you feel today or tomorrow.
Then contact a personal injury attorney.
And make no more statements about this on the internet.
I am a lawyer, I am not your lawyer.
Consult a personal injury lawyer regarding your claim. Because this collision involves a drunk driver, there may be punitive/exemplary damages available. Although those are not usually covered by insurance policies, the insurance company still has a duty to get the claim resolved to protect its in insured from punitive/exemplary damages. A skilled personally injury lawyer will understand the interplay and will be able to discuss options with you regarding your claim.
If you were ok then chances are you won’t get anything other than the repair of your car
Get a lawyer. They take 33.3% but are worth every penny. The insurance company has a team of lawyers and will screw you over and give you least amount possible. A lawyer on your side makes more money the more they get from the insurance company. I’ve been hit twice on my motorcycle, both times totaled the bikes and left me with hospital bills. The last accident the insurance company only wanted to give me $5k for my bike, that was KBB value and looking at similar bikes for sale. My bike was a 2 year only bike and the lawyer got me $12k. It’s like the lawyer from my first accident said “it’s easy to put a price on your vehicle and your hospital bills but how can you put a price on pain and suffering?” The answer was full policy limits and after paying my hospital bills, and getting paid for my bike I walked away with $80k. Get a lawyer, the insurance company already has them.
The point of insurance is to indemnify you. It’s to get you back to the point where you were before the accident occurred. You won’t be able to get rich off of it without some sort of fraud involved unless you’re injured and not are unable to work or something like that. There is a lot that goes into it. Get an attorney or a public adjuster
Generally you will only get money that will make you whole, not any more. So you’ll get the value of your car and you’ll get money for expenses occurred because of the accident (medical, time off work, etc).
You start by contacting your insurance to file a claim.
Having been in a couple of wrecks, that were not my fault, I can tell you that you’ll probably feel a lot worse in two to three days. It takes awhile sometimes.
Sometimes your insurance will negotiate with their insurance on your behalf but only for your car. A lawyer will often do a better job because there are other things to consider than the value of your car.
If you decide to not get a lawyer then the insurance company, of the person who hit you, will eventually send you a check. Read the back of the check completely. Get a magnifying glass. It will say that by endorsing the check you agree that you will never get another dime from them. If you are OK with that amount then sign it and go about your life. Otherwise you need to argue and get more. You can get more. They always try to low ball you with the first check. They may tell you to go ahead and sign that check and they’ll send you an additional one. Do not sign it until you have both checks, in your hand, and are OK with the amount. They are not your friend. Their job is to pay you the least amount possible.
A lawyer would make it easier on you and if their fee doesn’t cut into the price you need for a new car then it will be worth it. Most won’t charge you for a consultation so at least talk to one. Google “Personal injury lawyers near me” to find one.
In a few days you’ll probably start getting letters from a bunch of them because they check all public records for accidents.
Go to the ER and get checked out immediately. Sometimes pain and other symptoms can take several days to appear.
Do NOT talk to anyone on the phone who represents the other party or their insurance provider before you talk to a lawyer (and even then you should refer them to your lawyer). Do not give a statement, negotiate with them or speak to them at all until you talk to a lawyer. Anything you say to them could be used against you if you decide to sue.
I am an insurance adjuster, not a lawyer.
Do not tell the insurance company you are not injured. Most companies will give you $2500-$3000 with no treatment for soft tissue injuries. If you get an attorney they could get you more but they’re likely taking at least 30%. They’ll also probably want you to get treatment so it depends on if you think you actually need it. Lots of ambulance chasers will get you in for all sorts of chiro and they’re just doing it to rack up bills. You’re gonna be sore, take some advil and rest.
You get some treatment could get a little more. Just depends on how far you want to go.
Insurance owes you the value of your car before it was wrecked. Document the custom parts and equipment but don’t expect anywhere near what you paid for it, it’s a value added thing. Tinted windows for example might add $100. 4 new tires $250.
If you have collision coverage thru your own insurance file a claim. See what they offer. See what the other insurance offers. Take the best offer.
If you were delivering at the time of the accident you need commercial insurance or a special endorsement. If you don’t have that avoid your own insurance and make sure you get it in the future. It’s expensive but you’re a way higher risk since you drive for a living.
The single most important thing is to not settle for as long as possible.. Whiplash especially can get worse over time.
Your car claim and your medical claim are separate and you don’t have to settle them at the same time.
